Welcome to 49 Xclusive. These Terms & Conditions govern your use of 49xclusive.com and our online store at shop.49xclusive.com (together, the “Website”). By using the Website or placing an order, you agree to these terms. If you do not agree, please do not use the Website.

1. About us

The Website is operated by 49 Xclusive, a business registered in Malaysia with the Companies Commission of Malaysia (SSM). References to “we”, “us” and “our” mean 49 Xclusive.

2. Use of the Website

You must be at least 18 years old, or use the Website with the consent of a parent or guardian.
You agree not to misuse the Website, interfere with its operation, or attempt to access it by any means other than the interface we provide.
You are responsible for keeping your account details confidential and for all activity under your account.

3. Products and pricing

We make every effort to show product colours, sizes and details accurately. Actual colours may vary slightly depending on your screen and lighting.
All prices are in Malaysian Ringgit (RM) and may change without notice. The price that applies is the one shown when you place your order.
If a product is listed at an incorrect price, we may cancel the order and refund any amount paid.

4. Orders and payment

An order is accepted only when we confirm it by email. We may decline or cancel an order, for example where stock is unavailable or payment cannot be verified. Payment must be made in full through the payment methods offered at checkout. Our Terms of Sale set out ordering, shipping, returns and exchanges in more detail and form part of these terms.

5. Promotions and vouchers

Promotions, discount codes and vouchers are subject to their stated conditions, cannot be exchanged for cash, and may be withdrawn at any time unless stated otherwise.

6. Intellectual property

All content on the Website — including the 49Xclusive name and logo, designs, photographs, text and graphics — belongs to 49 Xclusive or its licensors and is protected by law. You may not copy, reproduce or use it for commercial purposes without our written permission.

7. Third-party links

The Website may link to third-party sites such as marketplaces, payment providers and social media. We are not responsible for their content or practices.

8. Limitation of liability

To the extent permitted by law, 49 Xclusive is not liable for any indirect or consequential loss arising from your use of the Website or our products. Nothing in these terms limits your rights under the Consumer Protection Act 1999 or other applicable Malaysian law.

11. Governing law

These terms are governed by the laws of Malaysia, and any dispute is subject to the jurisdiction of the courts of Malaysia.
